MUSIC CHOICE “13 DAYS OF GIVEAWAYS” SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN ALASKA, HAWAII, PUERTO RICO, THE U.S. VIRGIN ISLANDS, U.S. MILITARY INSTALLATIONS IN FOREIGN COUNTRIES AND WHERE PROHIBITED BY LAW.
1. Entry Period/Sponsor: Music Choice “13 Days of Giveaways” Sweepstakes (“Sweepstakes”) commences at 12:01AM (ET) on Friday, December 1, 2023 and ends at 11:59PM (ET) on Wednesday, December 13, 2023 (the “Entry Period”). Sponsor: Music Choice, 650 Dresher Road, Horsham, PA 19044 (“Sponsor”).
2. Eligibility: The Sweepstakes is open only to legal residents of the 48 contiguous United States of America (excluding Alaska and Hawaii) and the District of Columbia who are 13 years of age or older at the time of entry. Proof of residency and age may be required. If entrant is a minor based on the laws in the state where entrant resides (“Minor”), entrant needs to obtain permission from his/her parent/legal guardian to enter. Employees and their immediate families (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and members of their households (whether or not related) of Sponsor, and any other entities participating in the design, advertising, promotion, marketing, administration, or fulfillment agencies (collectively “Sweepstakes Entities”) are not eligible to enter Sweepstakes. Void to residents of Alaska, Hawaii, Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries and where prohibited by law.
3. To Enter: If you are a subscriber with access to Music Choice, you may enter the Sweepstakes by going to the Music Choice TV application accessible from your TV or the Music Choice mobile application on your mobile phone. While watching Music Choice on your TV or mobile application find a music channel or other panel with the QR code. Scan the QR code with your mobile device. It will prompt you to open the Sweepstakes entry page: https://www.musicchoice.com/13-days-of-giveaways (the “Website”). Once on that page, fill out the required information fields in the online entry form, follow the on-line directions, and click on the “Submit” button to enter the Sweepstakes.
You may also enter the Sweepstakes from a Music Choice social media post, e-mail blast or push notification by clicking on the link and opening the Website (https://www.musicchoice.com/13-days-of-giveaways). Once on that page, fill out the required information fields in the online entry form, follow the on-line directions, and click on the “Submit” button to enter the Sweepstakes.
You may submit one (1) entry to the Sweepstakes per person per day during the Entry Period. As provided in Section 4 of these Official Rules, a winner(s) will be randomly selected each day only from the entries received that particular day during the Entry Period. All Website entries must be received by the end of a particular day during the Entry Period in order to participate in that particular day’s random selection of the prize for that day. The Website’s database clock will be the official timekeeper for online entries in this Sweepstakes. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed void. In the event of a dispute, the Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes.
You may also enter by hand printing your full name, zip code, birth year, e-mail address, the prize day you are entering (for example, as applicable, “Day 1”, “Day 2”, etc.) and if applicable, TV provider, and how you heard about this Sweepstakes (e.g. the specific MUSIC CHOICE® Television channel, the Music Choice website, from a friend, etc.) on a 3” x 5” card and mailing it in a first-class postage prepaid envelope to “Music Choice 13 Days of Giveaways Sweepstakes”, 650 Dresher Road, Horsham, PA 19044. You will receive one entry into this Sweepstakes for each properly completed card received by Sponsor as provided herein, provided that no more than one (1) entry per person postmarked each day during the Entry Period will be accepted as an eligible entry. Subject to the immediately foregoing sentence, all written entries must be postmarked on or before the prize day for which the entry is submitted, and received by Sponsor before 11:59 pm (ET) on the day which is five (5) calendar days after the prize day (for example only, if submitting a written entry for the first prize day, the entry must be postmarked by December 1, 2023 and received by Sponsor no later than 11:59 pm ET on December 6, 2023).
For the avoidance of doubt, only one (1) entry (via the Website or a written entry) per person each day during the Entry Period is permitted. Any other attempt at Internet, e-mail or mail entry (i.e., other than as expressly set forth in this paragraph 3) is void. The Sweepstakes Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries. All entries (Website or written) shall become the Sponsor’s property and will not be returned or acknowledged. By entering, participants warrant and represent that they agree to be bound by these Official Rules and the final decisions of Sponsor. Entries submitted in compliance with these rules will be herein referred to as “Eligible Entries.”
4. Prize Winners Selection/Notification: There will be a total of fifteen (15) prize winners (each a “Prize Winner”), with one (1) Prize Winner randomly selected from among all the Eligible Entries received for that particular day during the Entry Period, except that on Day 13 of the Entry Period, three (3) Prize Winners will be so randomly selected. Each Prize Winner may only win one (1) prize during the Sweepstakes, regardless of how many days the Prize Winner may have entered during the Entry Period. Sponsor will make up to three (3) attempts over the twenty-four (24) hour period following the potential Prize Winner’s selection to contact the potential Prize Winner via the email address provided on their entry form. If a potential Prize Winner cannot be reached during the twenty-four (24) hour period after which they are emailed, the potential Prize Winner will be disqualified and an alternate Prize Winner may be selected from among the remaining applicable Eligible Entries received, if time permits. Each Prize Winner will be selected on or about the sixth (6th ) calendar day following each Entry Period day (for example only, the Prize Winner for Day 1 of the Entry Period (i.e., December 1, 2023) will be selected on or about December 7, 2023).
5. Prize Winner Verification: Each potential Prize Winner must prove eligibility, including, without limitation, proof of age and residence (as determined by Sponsor in its sole discretion) for prize fulfillment purposes within three (3) days of being notified as a potential Prize Winner. In the event of non-compliance by the potential Prize Winner, such potential Prize Winner shall be disqualified and all privileges otherwise due as the Prize Winner shall be terminated and an alternative potential Prize Winner may be chosen from among all of the remaining applicable Eligible Entries received in Sponsor’s sole discretion. The potential Prize Winner must sign (his/her parent/legal guardian must sign if Prize Winner is a Minor) within three (3) days of receipt of such documents from Sponsor: (a) an affidavit of eligibility and release of the Sweepstakes Entities from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with these Sweepstakes or the use/misuse or acceptance of the Prize or any portion thereof to be eligible for the Prize; and (b) except where prohibited by law, a promotional release granting the Sweepstakes Entities the right to use their name and likeness for advertising and publicity purposes without additional compensation. Entry into these Sweepstakes constitutes agreement to sign such releases. Prize Winner must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the timeframe specified or Prize Winner may forfeit the Prize at Sponsor’s sole discretion. All decisions of Sponsor relating to these Sweepstakes are final. Sponsor expressly reserves the right to delay the announcement of the Prize Winner for creative or technical reasons or for any other reason Sponsor deems necessary. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
6. Prizes: The Prize(s) to be awarded from each day’s Eligible Entries are set forth below (each a “Prize”). Sponsor is not responsible if the potential Prize Winner is unable or unavailable to accept the Prize. The approximate retail value (“ARV”) of each of the Prizes is also set forth below. Any difference between the ARV for a Prize and the actual value, if any, will not be awarded. No other substitution, transfer or cash equivalent permitted. Sponsor reserves the right not to award a Prize if it determines, in its sole discretion, that an insufficient number of Eligible Entries were received on any particular day during the Entry Period.

No transfer, or cash or other substitution of any prize allowed except that Sponsor reserves the right, in its sole and absolute discretion, to substitute a prize or prize component of comparable or greater value. The dates for fulfillment/shipment of each Prize will be on or about January 12, 2024 and is subject to change in Sponsor’s sole discretion.
7. General Terms: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and by the interpretations of these Official Rules and decisions of Sponsor, which are final in all matters relating to the Sweepstakes. Participation in the Sweepstakes and acceptance of the Grand Prize constitutes the winner’s permission (and, if a Minor, parent/legal guardian’s permission on winner’s behalf) for Sponsor to use winner’s name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by the winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrant agrees (and, if a Minor, parent/legal guardian agree on entrant’s behalf) on his/her behalf, and on behalf of his/her respective heirs, executors, administrators, legal representatives, successors and assigns to release and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from any and all liability, for loss, harm, damage, injury, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, costs or expenses whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with participation in the Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes related activity and for any claims based on publicity rights, defamation or invasion of privacy and prize delivery. Sponsor reserves the right to cancel, modify or suspend the Sweepstakes or any portion thereof should causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes, in which case prizes will be awarded via random drawings from among all Eligible Entries received prior to cancellation. Sponsor reserves the right to disqualify any entrant who does not comply with these Official Rules, or attempts to interfere with this Sweepstakes in any way. NEITHER SPONSOR NOR THE SWEEPSTAKES ENTITIES MAKE ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (UNLESS SPONSOR PROVIDES THE PRIZE WINNER WITH WRITTEN WARRANTIES). FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS OR ACTS OF ANY GOVERNMENT OR AUTHORITY.
8. Disputes: Any and all legal actions or claims arising in connection with this Sweepstakes or these Official Rules must be brought in a court of competent jurisdiction within the Commonwealth of Pennsylvania and will be governed by and interpreted under the laws of the Commonwealth of Pennsylvania without regard to its conflicts of law provisions and shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
9. Request for Name of Prize Winners and Official Rules: To obtain list of winners or Official Rules, send a self-addressed stamped envelope to: Music Choice, Attn: Music Choice 13 Days of Giveaway Sweeps, 650 Dresher Road, Horsham, PA 19044. All requests for a copy of the Official Rules and for the names of the Prize Winner must be made by January 15, 2024. Please note on the outer, front, left-hand corner of your envelope whether you are requesting “Official Rules” or the name of the “Prize Winner”.
10. PRIVACY POLICY: ENTRY IN THE SWEEPSTAKES CONSTITUTES ENTRANT’S CONSENT TO USE THE PERSONAL INFORMATION COLLECTED FROM THE ENTRANT FOR PURPOSES OF ADMINISTERING THE SWEEPSTAKES AND FOR SUCH OTHER PURPOSES TO WHICH ENTRANT MAY CONSENT AS OUTLINED HEREIN OR ON SPONSOR'S WEBSITE. ALL INFORMATION SUBMITTED TO SPONSOR AS PART OF THE SWEEPSTAKES WILL BE TREATED IN ACCORDANCE WITH SPONSOR’S PRIVACY POLICY, AVAILABLE AT https://musicchoice.com/legal/privacy-policy/
11. Restrictions: Sponsor shall not be liable to any winner or any person claiming through such winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor's sole control. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Any third-party trademarks mentioned herein are the property of their respective trademark owners. The use or mention of such third-party trademarks in these Official Rules or in the Sweepstakes is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Sweepstakes. You are providing your information to the Sponsor and the information you provide will only be used in accordance with the Official Rules of this Sweepstakes.
